Terms and Conditions for Urban at the Heights

Welcome to Urban at the Heights! These Terms and Conditions govern your use of our website (urbanattheheights.holidayfuture.com) and serve as the rental agreement for bookings of our fully furnished properties located at 4142 44th Street, San Diego, CA 92105.
By inquiring, booking, or staying at our property, you agree to these Terms and Conditions. If you do not agree, please do not use our website or book a stay.
1. Bookings and Payments
- Bookings are confirmed upon receipt of the required deposit or full payment (as specified during booking).
- Rent is due monthly in advance. Late payments may incur a fee of 5% of the overdue amount.
- Utilities (water, electricity, gas, Wi-Fi) are included unless otherwise stated.
- A refundable security deposit (equivalent to one month's rent) is required to cover any damages or additional cleaning. It will be returned within 14 days after move-out, minus any deductions (with itemized receipts provided).
2. Length of Stay and Occupancy
- Minimum stay: 31 days (mid-term and long-term rentals only).
- Maximum occupancy: As specified for each unit (typically 2-4 guests, depending on size). Additional guests require prior approval and may incur extra fees.
- The property is for residential use only – no subletting, commercial activities, or events/parties without written consent.
3. House Rules
To ensure a comfortable and safe environment for all guests and neighbors:
- No smoking (including vaping or marijuana) inside the property or on balconies. A $500 cleaning fee will apply for violations.
- Quiet hours: 10:00 PM to 8:00 AM. Excessive noise may result in eviction without refund.
- No pets without prior written approval (pet fee and additional deposit may apply).
- Guests are responsible for keeping the property clean and tidy. Weekly housekeeping is not included; excessive cleaning required at move-out will be deducted from the deposit.
- No illegal activities, weapons, or hazardous materials.
- Parking: Limited to assigned spaces (if available); street parking is at guest's risk.
4. Check-In and Check-Out
- Check-in: After 4:00 PM (earlier by arrangement).
- Check-out: By 11:00 AM. Late check-out may incur fees.
- Guests must report any pre-existing damage upon arrival. An inventory checklist will be provided.
5. Maintenance and Repairs
- We maintain the property to high standards. Guests must report issues promptly.
- Guests are liable for damage beyond normal wear and tear (e.g., broken furniture, stains, lost keys).
6. Cancellation Policy
- Cancellations more than 30 days before check-in: Full refund minus any processing fees.
- 15-30 days: 50% refund.
- Less than 15 days: No refund, unless we re-book the dates (pro-rated refund possible).
- Early departure: No refund for unused days.
7. Liability and Insurance
- We are not liable for loss, damage, or injury to guests or their belongings. We recommend travel/renter's insurance.
- Guests agree to indemnify us against claims arising from their actions or negligence.
8. Changes to Terms
We may update these Terms at any time. The version in effect at booking applies to your stay.
9. Governing Law
These Terms are governed by California law. Any disputes will be resolved in San Diego County courts.
